MADURAI: The Madurai Bench of Madras Superior Courtroom lowered the payment amount payable by The Countrywide Insurance Company Minimal from Rs 17.63 lakh to Rs 15.12 lakh but upheld the purchase of Motor Accidents Claims Tribunal of Principal District Courtroom in Sivaganga in a fatal street incident. According to the insurance coverage enterprise, Prabu was on his way to Manamadurai from Thirupattur in Sivaganga district when he was fatally knocked down by a van in Might 2016.
The relatives submitted a petition with the district tribunal towards the owner and the insurance provider of the van, which ordered the insurance coverage firm to fork out the payment. But the enterprise refused, professing that the accused did not have a valid licence nor did he put on a helmet.
Later, the insurance coverage corporation submitted a petition with the Madurai Bench. Justice RMT Teekaa Raman upheld the district tribunal purchase and modified the compensation to Rs 16.8 lakh. Referring to a division bench judgment that has preset 10 % on contributory carelessness, the compensation was further lowered to Rs 15.12 lakh. The courtroom directed the insurance coverage firm to pay the compensation and recover the identical from the operator of the auto.
